Terms and Conditions of Elrod.om Membership

Made In America Research, LLC and its members and affiliates (collectively and individually, "we", "our" or "us") operates one or more websites offering information and services to authorized users. These may include information, data, content, news, reports, programs, video, audio and other materials and services, communications, transmissions and other items, tangible or intangible, (collectively, “Our Services"). By checking and clicking on the acceptance box at the end of this Terms of Use Agreement (“Agreementâ€), you acknowledge that you have read, understand and agree to be bound by the terms set forth in this Agreement. Your use of any of Our Services (including the advertising of your products or services on our website, submitting memorials, stories, recipes, and hall of fame candidates) also constitutes your acknowledgment of, and agreement to be bound by this Agreement. This Agreement is the entire agreement between you and us unless there is another written agreement between you and us that addresses your use of part or all of Our Services. If there is another such agreement and those terms conflict with this Agreement, the specific terms of that agreement will take precedence over this Agreement. Whenever new materials or services become part of Our Services, your use of them will be subject to this Agreement unless we notify you otherwise or we sign a separate written agreement to the contrary. We may modify this Agreement at any time and the modifications will be posted on our website under the elrod.com blog link. Such modifications become binding when they are posted. If any modification is unacceptable to you, you must discontinue your use of Our Services immediately. Use of Our Services after the date that the modification is posted means that you agree to the modification. No change to this Agreement is valid unless the change: (1) is posted on the website; (2) is part of special terms as described above; or (3) is in a separate agreement executed by us.
Limitations on Use
Information or data acquired from us (“Materialsâ€) may have copyright or similar notices. These may not be removed or modified. You may not republish, distribute any Materials or do anything else with Materials that is not specifically permitted in this Agreement. Your submissions to this site for display are reviewed prior to being included in the site data base. Acceptance of these submissions is determined in accordance with the Acceptable Use paragraphs of this document and solely at our discretion.
Anti-hacking Provision
You may not, nor may you allow others to, directly or indirectly: (a) attempt to or actually disrupt, impair or interfere with, alter or modify any of Our Services, or (b) collect or attempt to collect any information of other authorized users,
Acceptable Use – Spam, Mass Mailing, File Sharing
Spam –
We don't allow spam and work to reduce the amount of spam sent to Elrod.com and received by the Elrod.com email service.
By using Elrod.com personalized email addresses, you agree not to use your account to send spam. You also agree to take reasonable steps to ensure your account is not used by others to send spam. If your account is deemed to be sending spam, we will suspend and/or terminate your service (without refund).
As part of our anti-spam efforts, we have systems in place that monitor account activity to detect malicious use.
Mass Mailing –
Our email service is for personal use. It doesn't allow for outbound mass mailing. The number of emails that can be sent per day from your account are limited, these limits allow for reasonable use by an individual.
File Sharing, Uploads and Submittals –
Elrod.com allows our members to store and/or share file uploading files via Webmail and/or through our member’s accounts. Elrod.com prohibits the uploading, sharing, or disseminating of any information, data, or material that is objectionable to us or others, including defamatory, child pornography, or hate literature, as well as any that is in violation of local, federal, or international regulation or law, or that is prohibited by common law. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute.
By agreeing to the terms and conditions in this document you explicitly agree Elrod.com has the sole right to determine the acceptability of uploaded and/or submitted data and weather to include it’s data base or not include it. You also agree to accept the liability, at your sole expense of submitting copyrighted materisl data.  You also agree to pay legal expenses either directly or reimburse Elrod.com  for any illegal posting.
We reserve the right, at our sole discretion, to lock any account that is found to be in violation of this policy.
Illegal Activities –
Services offered may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material that is in violation of federal or state regulation or law, or by common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute.
We reserve the right to cooperate with law enforcement and other legal authorities in investigating claims of
Limitation of Liability
You are liable for activities conducted by you or anyone else in connection with your use of Our Services and of any Materials. If you are dissatisfied with the Our Services, any Materials or the terms of this Agreement, your sole and exclusive remedy is to stop using the Our Services and the Materials. We do not warrant the accuracy, completeness, currentness or other characteristics of any of Our Services or Materials. We will not be liable for any loss or injury resulting directly or indirectly from your use of Our Services or any Materials, whether or not caused in whole or in part by our negligence or by contingencies within or beyond our control. Neither we, nor suppliers of third-party content, are liable, directly or indirectly, for any loss or damage caused by use of or reliance on (or inability to use or access) Our Services or any Materials. YOUR ACCESS TO AND USE OF OUR SERVICES ARE AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. WE ARE NOT AND WILL NOT BE A PARTY TO ANY TRANSACTION BETWEEN YOU AND ANY THIRD PARTY, WHETHER OR NOT THAT THIRD PARTY'S WEBSITE IS LINKED FROM OUR SERVICE.
Governing Law; Waiver; Severability
The laws of the state of Indiana govern this Agreement. You agree that venue and jurisdiction for any dispute will be in a federal or state court sitting in Marion County, Indiana. You agree and expressly consent to the exercise of personal jurisdiction in the state of Indiana. No failure or delay in enforcing any right shall be a waiver of that or any other right. If any term of this Agreement is held invalid, illegal or unenforceable, the remaining portions shall not be affected.
Copyright
Unless specifically stated in conjunction with particular Materials, all Materials are copyrighted by us. You have no rights in or to the Materials and you may By accepting the terms and conditions of this Agreement, you may not use any Materials other than as permitted under this Agreement without our express written consent. You agree by submitting materials for display on Elrod.com, no matter for what purpose these materials were submitted that these materials become the sole property of Made In America Research, LLC and therefore may be deleted or used for any purpose at the sole discretion of Made In America Research, LLC. You also agree that Made In America Research, LLC has no obligation, monetary or otherwise to compensate submitters for the materials they submit, now or at any time in the future.
Trademark
All trade names, trademarks, service marks and other product and service names and logos on or in Our Services or the Materials are the proprietary trademarks of their respective owners and are protected by applicable trademark and copyright laws. You are prohibited from, and agree to refrain from, using the trademarks of others without their express written consent.
